Mutual Consent Divorce in Cyprus: Procedure and Legal Considerations

A mutual consent divorce is the simplest and least time-consuming process for dissolving a marriage in Cyprus. It is a procedure in which both spouses agree to terminate their marriage and to the arrangements related to the divorce.

1. Requirements for a Mutual Consent Divorce
In order for a mutual consent divorce to be granted in Cyprus, the following are required:

There must be mutual agreement between both spouses.

At least six months must have passed since the marriage took place.

A notification must have been submitted to the competent Bishopric, in the case of a religious marriage.

3. Post-Divorce Arrangements
Following the dissolution of the marriage, certain issues may arise that need to be regulated, such as:

Child support: An application for child maintenance can be filed either before or after the issuance of the divorce. The amount of maintenance may also be agreed upon at the time of the divorce, in order to avoid future tensions between the parties.

Division of property: If there is joint property, a fair distribution between the spouses must be made within three years from the issuance of the divorce.
