Regulation of Child and Spousal Maintenance under Cypriot Law

Maintenance (alimony) is one of the most critical legal issues that arise during the dissolution of a marriage or relationship, especially when minor children are involved. Child Maintenance

The amount of maintenance is determined by the Family Court, taking into account the financial capabilities of each parent, the needs of the child, and the standard of living to which the child is accustomed.

An application for child maintenance can be submitted to the Family Court by the parent with whom the child resides. The Court examines all relevant evidence and makes its decision based on the facts presented. Child maintenance typically continues until the child reaches adulthood, or in some cases, even beyond that point if the child is still studying or unable to support themselves.

Spousal Maintenance
In certain cases, maintenance may also be awarded to the spouse who is in a weaker financial position. The Court evaluates the financial circumstances of both parties, the duration of the marriage, the spouse’s contribution to the household and the upbringing of the children, as well as any other factors that may affect the applicant’s financial needs.

Spousal maintenance may be granted for a fixed or indefinite period, depending on the circumstances. However, unlike child maintenance, it is not automatic and requires a thorough assessment of the case’s details.

Modification or Termination of Maintenance
Maintenance decisions can be modified at any time if there are changes in the financial conditions of the parties or in the needs of the child, or due to any other relevant circumstances. For example, if a parent experiences serious financial difficulties or if the child’s needs increase, the Court may revise the maintenance amount upon application.
